If they did that without either then the concept of war and hostility would be meaningless since they would be identical.
Except that the accidental attacks happen once every 10-30 turns and during war and hostility they're happening constantly.
It's one thing to trigger an accidental attack and then check if it is smart, than to seek out a smart attack and execute it.
