Diplomacy overexpansion penalty?

I found the CoM version in the changelog at 5.28 :

So it was 5+years, I wasn't sure if it's 3 or 7, well, neither.
One thing that's not specified here though is WHEN this triggers, I mean how often. Obviously it's not every turn, it even mentions that.

Just checking if this is outdated or I'm miscalculating - I had 9 cities in Dec 1410, small land, and conquered a new one. According to the formula (should be 10 elapsed years), (5+10)x0.75=11.25. So I should be able to have up to 11 cities. I got warnings by both other wizards though. What gives?

EDIT: I also tried another thing - waited a turn, which brought the date to Jan 1411. That should have made another year pass but I still got the warnings.

And another question about overextension - do AIs try to stay within the constraint of the formula? Maybe based on personality? And do these warnings go out amongst them, or it's only AI to human warning?

No, they don't hold back on expansion but yes the warnings do apply between AI as far as I remember, well, the relation penalty part of it anyway, as AI's don't actually have a warning system (no one will see the text anyway).
