I'm pretty sure CFC's face violates the spirit of the earth, but that's never stopped them.

If we're sure that they are sending intel to our enemies then the Open Borders needs to be canceled. It's stupid to keep it otherwise. That's like congratulating them for being dicks.

I don't see any issue in asking CFC to not share any intel until turn 175. I think this covered by our NAP...

We won't know until after the game. I doubt they'd admit to doing this while the NAP is still active, but you'd be hard pressed to convince me that this isn't exactly what they're doing. Probably though, it doesn't matter. I'm sure Poly/CP have spies running around, in addition to having city visibility on us.

We cancel the NAP and they can just claim that that means we're breaking the entire agreement and can declare war anytime they feel like it.

WHY? We're not alpha striking CFC. We don't have the men. And Civplayers just declared war.
Please explain why canceling the NAP does us a bit of good (the diplo fallout will be substantial - I don't want to risk our one ally if we can help it.)

This is what Tyrmith meant:

I have to run.

I just want to know whether sharing intelligence with the other party's enemies is against the agreement or not. Scooter hasn't responded yet.

I haven't responded because I think it's silly and I'm trying to be nicer . If someone can find something that has been violated then okay, produce it. I'm not going to go disproving the validity every crazy idea though.
