Er, guys, you don't all seem to be on the same page about what is & isn't allowed in this game. Trying to be spoiler free here, so a bit vague.
Some diplomatic contact has taken place quite a few turns in the past, and someone else has since posted that he thinks diplo is not allowed in this game.
I skim read (quite quickly) through the tech thread & the last thing I can find mentioning settings is a post by Cyneheard where he says:

I think the only later mention is another post from Cyneheard assuming that everyone agrees with all the settings as no-one said anything.
The diplo that took place appears to be due to genuine belief that it was allowed, incidentally, as someone asked why it was on in a player's thread & the answer was (paraphrased) "don't know but it is, so I'll use it".
And I dunno what, if anything, you want to do about it. But I thought you should all know there's some confusion.

I think it depends on what the diplo contact was, for what remedy there should be.
If an agreement was made to do X, then that agreement needs to be null and void.
If, instead, the chatter was passing information, there isn't a lot that can be done about it.
In either case, it needs to not happen again. I know I've received more info than I should have...

 I guess that's me then! I went back through the thread specifically before looking for it and I didn't see CTON. In fact I never actually saw it once. I've talked about the game with Scooter, Cyneheard and Nakor in gchats before and no one said, "Hey this a CTON"
Full disclosure, I had a discussion with Nakor about our border in which he agreed to plant a city in a different place by 1 or 2 tiles. Beyond that there was no agreement.
I just went back and looked through my emails. July 31 was first contact with Nakor. He said:

I looked through the tech thread and didn't see it so I replied:

So neither of us really knew. Beyond that we didn't really pass much information, until the one discussion we had that I previously mentioned. The above exchange prompted me to ask in the tech thread about Open borders.
So yeah, my bad. There's no real outstanding agreements or anything no gold or resource trades set up. I'm not sure how to penalize myself for it. Not too much I can do. I don't really think it gave us much of an advantage. Won't happen again.

I was thinking about it and the advantage that I got out of that exchange was that Nakor wasn't going to settle as such that his city would take a certain food resource. At present I still haven't settled said resource. I think my penalty should be that I can't settle that resource. This way the entire point of that diplo is erased. Technically if we hadn't diploed my settler would have beaten him there anyway, but I think its fair to say that by diplo I secured myself time to settle said resource. I think it's only fair that I lose said time and said resource as penalty instead.
What say you?

Yeah, border agreements should be right out (and gold/resource deals, likewise)...
Fine with me as recompense on the food res, that's really up to you and Nakor.
I know when we chatted, it was just idle speculation about the game.

Ah, Lewwyn's idea for making it even sounds fine to me. Just try to avoid it in the future. I've had an idle chat or two with Lewwyn and cyneheard where this game has come up, and I don't think that's a particularly big deal, but I've been operating under the assumption that any sort of negotiating or info sharing is off limits, as I think it should be. So yeah, that proposal from Lewwyn sounds fine and just be more careful in the future and we'll be fine. No biggie.

Yeah and it was the same for the most part with everyone else I chatted with. This instance with Nakor and his city was the only incident that may have had any impact on the game and even then it was minimal. Still, I think my solution will erase any possible advantage.

Sorry, that's what you get for not reading the rules yourself.
I'm ok with Lewwyn's proposal and won't talk to anyone about this game untill it ends in about a year or so...
